Terms & Conditions
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Cotrawell Inc. ("Cotrawell", "we", "us") governing your access to and use of the Cotrawell peer-to-peer travel marketplace, including all associated websites, mobile applications, and services (the "Platform").
By registering an account, listing a trip, or making a booking, you confirm that you have read, understood, and agree to these Terms.
2. Our Role as a Marketplace
Hosts are independent individuals or entities. Cotrawell does not verify the accuracy of all information provided by hosts, though we take reasonable steps to detect fraudulent listings. Users transact with each other at their own risk, subject to these Terms and the protections our platform provides.
3. Eligibility
To use Cotrawell, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts in your jurisdiction
- Not have been previously suspended or removed from the Cotrawell platform
- Provide accurate and complete registration information
Cotrawell is available to users in India and Canada. Use from other jurisdictions is permitted but is at the user's own risk, and Cotrawell makes no representations about legal compliance in other regions.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@cotrawell.com if you suspect unauthorised access to your account.
You may not share your account, create multiple accounts, or use another person's account without their explicit authorisation.
5. Host Obligations
If you list a trip on Cotrawell as a host, you agree to:
- Provide accurate and truthful information about the trip, vehicle, route, and seat availability
- Hold all required licences, registrations, and insurance required by law in your jurisdiction for carrying passengers
- Not charge travellers more than the amount agreed at the time of booking
- Honour confirmed bookings unless cancellation is unavoidable, in which case you must notify travellers promptly via the platform
- Treat travellers with courtesy and not discriminate on grounds of race, religion, gender, disability, or other protected characteristics
- Comply with all applicable traffic, road, and passenger transport laws
Cotrawell reserves the right to remove listings and suspend accounts that violate these obligations.
6. Traveller Obligations
As a traveller on Cotrawell, you agree to:
- Be at the agreed pickup location at the agreed time
- Carry only lawful goods and not endanger the safety of the host or other passengers
- Treat hosts and fellow travellers respectfully
- Pay the agreed fare and not attempt chargebacks except for legitimate disputes raised through the platform
- Leave accurate and honest reviews after completing a trip
7. Bookings & Payments
Booking confirmation
A booking is confirmed when you receive a written confirmation from Cotrawell via email or in-app notification. A confirmed booking creates a direct agreement between the traveller and the host; Cotrawell facilitates but is not a party to this agreement.
Payments
Payments are processed through our third-party payment processor. Cotrawell collects a service fee on each transaction. The fee amount is displayed clearly before you confirm a booking. Cotrawell is not a bank or a payment institution.

Cancellation terms and refund entitlements are set out in our Refund Policy. Please review it before booking.
8. Prohibited Conduct
You must not use the Cotrawell platform to:
- Post false, misleading, or fraudulent listings or reviews
- Harass, threaten, or abuse other users
- Circumvent Cotrawell's payment system by arranging off-platform transactions
- Scrape, spider, or automatically extract data from the platform
- Introduce malware, viruses, or any harmful code
- Impersonate another person or entity
- Violate any applicable law, regulation, or third-party rights
Violations may result in immediate account suspension, removal of content, and/or legal action.
9. Intellectual Property
All content on the Cotrawell platform — including logos, design, software, and text created by Cotrawell — is the property of Cotrawell Inc. and is protected by copyright, trademark, and other applicable laws.
By posting content on the platform (such as trip descriptions or profile photos), you grant Cotrawell a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content for the purpose of operating and promoting the platform.
10. Termination
You may close your account at any time by contacting us at support@cotrawell.com. Outstanding bookings, financial obligations, or unresolved disputes must be settled before closure.
Cotrawell may suspend or terminate your account without notice if you breach these Terms, engage in fraudulent activity, or pose a safety risk to other users. We may also terminate accounts at our discretion with 30 days' notice for operational reasons unrelated to misconduct.
11. Limitation of Liability
To the maximum extent permitted by law:
- Cotrawell provides the platform on an "as is" and "as available" basis without warranty of any kind
- Cotrawell is not liable for the actions, omissions, or conduct of any host or traveller
- Cotrawell is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
- Cotrawell's total liability to you for any claim arising under these Terms is limited to the amount of service fees paid by you to Cotrawell in the 3 months preceding the claim
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law in India or Canada.
12. Disputes Between Users
Cotrawell provides a dispute resolution mechanism accessible within the platform. We encourage users to raise disputes through this channel first. Cotrawell may, at its discretion, mediate between parties but is not obligated to resolve disputes between users.
Cotrawell is not liable for any loss arising from a dispute between a host and a traveller.
13. Governing Law
These Terms are governed by the laws of Canada, without regard to conflict of law principles. For users based in India, the provisions of the Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable Indian legislation shall also apply to the extent required by law.
Any legal disputes that cannot be resolved informally shall be submitted to the courts of competent jurisdiction in Canada, except where mandatory local law requires otherwise.
