Please read carefully. This Disclaimer limits Cotrawell's liability for certain risks inherent in using a peer-to-peer travel marketplace. By using Cotrawell, you acknowledge and accept these limitations.

1. Cotrawell Is Not a Transport Provider

Cotrawell Inc. operates a technology platform that enables independent trip hosts to connect with travellers. Cotrawell does not provide transportation services, does not employ trip hosts, does not own or operate any vehicles, and is not a carrier, travel agent, or logistics company.

Trip hosts are independent individuals who use the Cotrawell platform to offer seats in their vehicles. The travel arrangement you enter into is directly between you and the host. Cotrawell is not a party to that arrangement.

2. No Warranties

The Cotrawell platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Cotrawell makes no representations or warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the platform will be uninterrupted, error-free, or free from viruses or other harmful components
  • That any trip listings are accurate, complete, or current
  • That hosts are licensed, insured, or qualified to carry passengers
  • That the platform will be available in any particular location or at any particular time

3. User Conduct

Cotrawell does not endorse, guarantee, or take responsibility for the conduct, behaviour, or character of any user — whether a host or a traveller. We take reasonable steps to moderate the platform, but we cannot guarantee the conduct of any individual user before, during, or after a trip.

Users are solely responsible for verifying the identity and suitability of the other party before agreeing to travel together. Cotrawell encourages users to exercise reasonable caution and good judgment.

4. Third-Party Links and Services

The Cotrawell platform may contain links to third-party websites or services. These links are provided for your convenience only. Cotrawell does not endorse, control, or accept responsibility for the content, privacy practices, or services of any third party.

Your use of third-party websites or services is at your own risk and subject to their respective terms and policies.

5. Safety and Travel Risk

Peer-to-peer travel involves inherent risks. By using Cotrawell, you acknowledge and accept that:

  • Travel carries risk of accident, injury, delay, or loss regardless of the mode of transport
  • Cotrawell cannot guarantee the roadworthiness of any vehicle offered by a host
  • Cotrawell does not verify whether hosts carry adequate insurance for carrying passengers
  • Weather, road conditions, and other external factors may affect your journey

We strongly recommend that travellers carry their own personal travel insurance. Cotrawell is not responsible for any personal injury, property damage, or loss incurred during or in connection with a trip booked through the platform.

6. Accuracy of Platform Content

While Cotrawell makes reasonable efforts to ensure the accuracy of content on the platform, we do not warrant that trip listings, pricing, seat availability, or any other user-submitted content is accurate, complete, or current. Errors or inaccuracies may exist and you rely on platform content at your own discretion.

8. Limitation of Liability

To the maximum extent permitted by applicable law in India and Canada, Cotrawell, its directors, employees, agents, and affiliates will not be liable for:

  • Any personal injury, death, or property damage occurring during or in connection with a trip booked through the platform
  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, goodwill, or reputation
  • Any damages resulting from unauthorised access to or use of your account
  • Any damages resulting from the conduct of any host or traveller

Nothing in this Disclaimer excludes liability for death or personal injury caused by Cotrawell's own negligence, for fraud, or for any liability that cannot be excluded under mandatory applicable law.

9. Jurisdiction

This Disclaimer is governed by the laws of Canada. For users in India, nothing in this Disclaimer overrides rights you may have under the Consumer Protection Act, 2019 or other mandatory Indian consumer protection legislation.
